  • How your service charge is calculated – by financial year

    Hyde’s financial year:

  • Your estimated service charge

    Before the start of the financial year, we set our customers in homes managed by managing agents a service charge estimate for the upcoming year. This is calculated based on the most up to date budget available. You should receive a copy of your estimated service charge by the end of February each year.

  • Budget

    A budget for your building or estate is provided by your managing agent, who is contracted by the freeholder (not Hyde) to provide services for your building or estate. The budget details the anticipated costs for the services expected to be provided over the financial year.

    During the financial year, your managing agent will issue invoices to us (Hyde) against the service charge budget, and annual accounts.

    At the end of your managing agent’s financial year, they will reconcile their accounts. Their reconciliation will detail the actual expenditure for all services provided to your estate during their financial year, against their budgeted costs. Following reconciliation, a balancing charge will be issued to Hyde for any difference between the budgeted costs and actual expenditure (this could be a debit or credit value).

    If your managing agent is unable to reconcile their accounts within six months of the end of their financial year, they will issue a Section 20(b) notice.

    A Section 20B notice is a legal document landlords use to inform leaseholders of incurred service charge costs within 18 months of those costs being incurred. This notice preserves the landlord’s right to recover those costs from leaseholders, even if the final demand is issued after the 18 month window.

  • Final service charge

    At the end of Hyde’s financial year, your account will be reconciled, and you will be issued with a final service charge statement and corresponding balance (debit/credit). You should receive a copy of your final service charge statement by the end of September each year. If we’re unable to issue your statement by this time, we will issue a Section 20(b) notice.

    The final balance is the difference between your estimated service charge and the costs we have incurred for your home during the financial year. The incurred costs would likely include, but not limited to, the annual budgeted costs from your managing agent along with a balancing charge (credit/debit) from their previous year’s account reconciliation.

Legal relationships and responsibilities

  • Leaseholder

    There are often multiple legal relationships in relation to the ownership of the property. The leases will set out the legal responsibilities for all those party to the lease.

    Detailed within each lease will be information on which party is responsible for each area within the title.

  • Freeholder

    The freeholder would be the ‘superior landlord’ and is usually responsible for the repair and maintenance of the exterior and common parts of the building (responsibilities would be detailed within the lease).

  • Managing agent

    A managing agent is often appointed by the freeholder to provide services to the estate on their behalf. 

  • Headlease

    A headlease is a lease granted out of the freehold and is usually a superior lease over a building. Out of this headlease underleases are granted. The common scenario is a headlease over a building containing flats which in turn grants underleases to individual flats in a building. There can however be a headlease in other building types. The owner of the headlease would be the landlord to underlessee.

  • Underlease

    An underlease is a lease granted out of a headlease and in most cases would be owned by the resident of the property.
